Solar-Fabrik AG: Self administration reconfirmed
The local court in Freiburg decided that the insolvency proceeding of Solar-Fabrik AG (ISIN: DE0006614712) should continue under self administration, again, with immediate effect. Self administration was initially declined by the local court on May 1st, 2015, despite the fact that the preliminary proceedings happened under self administration and the insolvency filing proposed to continue self administration. The revised decision by the local court follows the rationale from both the creditors’ committee as well as the self administration that this set up provides a higher probability to find investors for Solar-Fabrik’s future.

Das Amtsgericht Freiburg hat mit sofortiger Wirkung das Insolvenzverfahren über das Vermögen der Solar-Fabrik AG (ISIN: DE0006614712) wieder als Verfahren unter Eigenverwaltung angeordnet. Für das am 01.05.2015 eröffnete Verfahren wurde zunächst die Eigenverwaltung abgelehnt, obwohl das vorläufige Verfahren bereits in Eigenverwaltung stattfand und auch das Insolvenzeröffnungsgutachten die weitere Eigenverwaltung vorschlug. Mit der heutigen Entscheidung folgt das Amtsgericht der Argumentation von Gläubigerausschuss und Vorstand, wonach die Eigenverwaltung die besten Chancen hat, eine Weiterführung für die Solar-Fabrik zu erreichen.
